Economic analysis of French Labor Courts
[Analyse économique des conseils de prud'hommes : Enjeux et Perspectives]

Abstract

Les conseils de prud'hommes suscitent depuis longtemps multiples débats et polémiques mais représentent cependant un élément clef de la législation protectrice de l'emploi effective. Peu de travaux de recherches en économie ont pourtant analysé cette institution. Partant de ce constat, l'objectif de cet article est de proposer une synthèse du fonctionnement des conseils de prud'hommes, appuyée sur des données quantitatives. Nous nous intéressons ici à la procédure prud'homale, c'est-à-dire aux règles de fonctionnement des conseils de prud'hommes, et non au contenu des règles de droit. Cette synthèse sera guidée par les questions suivantes : Pourquoi réformer les conseils de prud'hommes? Comment les réformer? Pour répondre à ces questions, nous rassemblons dans cet article des éléments essentiellement quantitatifs sur les conseils de prud'hommes. Nous nous appuyons sur des données fournies par le Ministère de la Justice de 2004 à 2015. Nous présentons tout d'abord les difficultés auxquelles les conseils de prud'hommes font face et qui appellent à réformer cette institution. Nous analysons ensuite avec les outils de l'analyse économique du droit les récentes réformes de cette institution, ainsi que quelques futures pistes de réformes. Enfin, nous discutons en conclusion les enjeux, les difficultés et les perspectives de recherches sur ce thème.
