Punkte machen?! Warum Deutschland ein aktives Auswahlsystem für ausländische Fachkräfte braucht

Abstract

In die deutsche Zuwanderungsdiskussion ist Bewegung gekommen. Es mehren sich die Stimmen, die mit Blick auf den einsetzenden Mangel an Fachkräften in einzelnen Segmenten des Arbeits-marktes für Deutschland die Einführung eines Punktesystems zur Auswahl geeigneter Zuwanderer aus nichteuropäischen Staaten fordern. Auf der anderen Seite lehnen Gegner eines solchen Steuerungssystems dieses inzwischen zusehends seltener aus kategorischen Gründen ab. Sie verweisen vielmehr darauf, dass Deutschland nach den wiederholten gesetzgeberischen Reformen der letzten Jahre bereits über ein sehr großzügiges Zuwanderungsgesetz verfüge, das faktisch wie ein Auswahlsystem wirke. Es gelte lediglich, es im Ausland noch besser bekannt zu machen. Auch wird darauf verwiesen, dass sich klassische Einwanderungsländer wie Australien und insbesondere Kanada in jüngster Zeit schrittweise vermeintlich von ihren eigenen Punktesystemen entfernt hätten. Ist ein Punktesystem also nicht mehr zeitgemäß und auch für Deutschland keine attraktive Option? Dieser Beitrag widerspricht dieser Einschätzung und erläutert, warum Deutschland das bestehende Gesetzeswerk straffen und um ein Punktesystem erweitern sollte. Deutschland könnte sich so aktiver als bislang im Wettbewerb der Standorte um gesuchte Fachkräfte etablieren und mit einem Punktesystem zugleich die gesellschaftliche Akzeptanz von Zuwanderung und Zuwanderern weiter stärken. Der Beitrag erneuert und erweitert einen von den Autoren bereits 2011 vorgelegten Vorschlag zur konkreten Ausgestaltung eines differenzierten Auswahlsystems für Fachkräfte.
