Vergleichende Studie über die Befugnisse und die Repräsentativität der Arbeitnehmervertreter in französischen und deutschen Unternehmen

Abstract

Im ersten Teil der Studie wird der institutionelle Rahmen von Arbeitnehmervertretungen und Tarifverhandlungen zwischen Frankreich und Deutschland verglichen. Ein wichtiger Unterschied besteht darin, dass in Frankreich viele Aspekte der Tarifverträge im Arbeitsrecht gesetzlich festgelegt sind, wohingegen die Tarifvertragspartner in Deutschland einen größeren Gestaltungsspielraum haben. Der zweite Teil behandelt die ökonomischen Effekte unterschiedlicher institutioneller Rahmenbedingungen. Eine höhere Lohnflexibilität hat positive Auswirkungen auf Wettbewerbsfähigkeit und Beschäftigung. Im letzten Teil der Studie werden die Reformvorschläge von Jean-Denis Combrexelle, Präsident der Abteilung für soziale Angelegenheiten des Staatsrats, bewertet. Die Vorschläge, bei Tarifverhandlungen einen größeren Spielraum zuzulassen und Verhandlungen auch auf Firmenebene zu ermöglichen, werden positiv beurteilt. Eine fest vereinbarte Laufzeit von Firmentarifverträgen anstelle einer unbestimmten Vertragsdauer würde die Unsicherheit sowohl für Firmen als auch für Arbeitnehmer verringern. Die Umsetzung dieser Reformvorschläge wäre am effektivsten, wenn diese mit einer Friedenspflicht einhergehen würden, was bedeutet, dass während der vereinbarten Laufzeit keine Streiks erlaubt sind. Der Vorschlag, an der Ausweitung von Branchentarifverträgen durch den Arbeitsminister festzuhalten, ist kontraproduktiv und würde die positiven Effekte anderer Reformvorschläge teilweise wieder konterkarieren.
