Evaluation des Maßregelvollzugs: Grundzüge einer Kosten-Nutzen-Analyse

Abstract

Kriminal-, Sozial- und Gesundheitspolitik haben die undankbare Aufgabe, bei ihren Entscheidungen zwischen zwei großen Kostenblöcken abwägen zu müssen, die einerseits in den gesellschaftlichen Kosten des Kriminalitätsrisikos durch psychisch kranke Tätergruppen, und auf der anderen Seite in den Kosten der sichernden Neutralisierung und/oder Behandlung dieser Personengruppen bestehen. Eine zentrale Rolle spielt in dem komplexen System der Bestrafung, (Re-) Sozialisierung und Prävention der Maßregelvollzug für psychisch kranke oder suchtkranke Straftäter. Messbare Erfassung von Kosten, Erfolg oder Misserfolg sind Voraussetzungen für die Vorbereitung möglicher Reformen, aber auch hinsichtlich der Abwägung alternativer Unterbringung im Regelvollzug, in Sozialtherapeutischen Anstalten oder gar in Anstalten der Allgemeinen Psychiatrie. Die in dieser Studie vorgestellten Überlegungen zur Evaluation des Maßregelvollzugs gehen letztendlich der Frage nach, ob der gesellschaftliche Nutzen der Behandlungsmaßnahmen (z.B. vermiedenes Kriminalitätsrisiko) die Kosten der Maßnahmen überschreitet oder nicht. Mithilfe von Daten des Maßregelvollzugs des Landes Mecklenburg-Vorpommern werden in einer Fallstudie Möglichkeiten und Grenzen der Kosten-Nutzen-Analyse illustriert.
