Derecho Administrativo Sanitario Tomo II. Seguridad en los Alimentos y Acceso a los Medicamentos

Abstract

Los alimentos y los medicamentos son bienes especiales por su trascendencia para la humanidad. Asegurar el acceso generalizado a unos y otros es un reto que ha llevado a fijar objetivos planetarios internacionales para lograr el “hambre cero” en el horizonte 2030, e igualmente lograr acceso a los insumos básicos de la salubridad pública, como son los medicamentos. Los dos plantean también exigencias de seguridad, por condiciones mínimas de inocuidad, o ausencia de consecuencias dañinas en la extensa cadena de producción de los alimentos, hasta su consumo, así como por los riesgos científicos inherentes al desarrollo de nuevos medicamentos, a lo que se suman los enormes y crecientes intereses económicos que comprometen complejos engranajes comerciales, grandes inversiones económicas y desarrollos tecnológicos que involucran patentes y derechos exclusivos. Medicamentos y alimentos plantean equilibrios complejos entre intereses individuales y el bien común, entre derechos económicos y derechos fundamentales, entre desarrollo de empresa y condiciones mínimas de salubridad, entre desarrollo tecnológico y precaución, equilibrios cuya definición pone en la palestra al derecho administrativo, mediante funciones de policía administrativa, en su arbitrio esencial entre derechos fundamentales e interés general, por medio de sus herramientas tradicionales de regulación, control y sanción, pero también acudiendo a otras, novedosas, que buscan la autorregulación y la legitimidad de reglas técnicas de soft law, la vinculación de los consumidores con mecanismos de información sobre los productos, y la exigencia de medidas de precaución frente a los riesgos vinculados con alimentos y medicamentos. Las contribuciones de esta obra colectiva analizan diversos aspectos de las competencias de la Administración en estas funciones, la complejidad de su interacción, las limitaciones de nuestras estructuras administrativas, ancladas en concepciones tradicionales, pese a sus denominaciones modernas, los esfuerzos institucionales importantes para el logro de mayor seguridad, así como los balances inciertos ante los grandes intereses económicos en juego y la capacidad institucional real para escapar a su influencia, en beneficio de toda la colectividad.
