Vertrauen und Recht: eine ökonomische Analyse

Abstract

Mit Hilfe eines einfachen Vertrauensspiels wird die Bedeutung des Vertrauens als Verhaltensphänomen in der Ökonomie dargelegt und ein Vertrauenskonzept entwickelt, das dem Umstand eingeschränkt rationalen Verhaltens Rechnung trägt. Es wird gezeigt, daß trotz der Einbettung einer Transaktion in die Rechtsordnung und des Rückgriffs auf nicht rechtliche Schutzvorkehrungen gegen Opportunismus für einen Vorleister ein Restrisiko existiert, daß die kooperative Gegenleistung unterbleibt. Vertrauen offenbart sich in der Übernahme dieses Restrisikos. Abschließend wird die Effizienz des Vertrauens diskutiert und die Rolle des Rechts bei der Selektion vertrauenswürdiger Transaktionspartner untersucht.
