Täuschung Im Lebensmittelverkehr – Ein Prinzipal-Agenten-Modell

Abstract

Lebensmittel sind Produkte des täglichen Bedarfs und weisen dabei zahlreiche Erfahrungs- und Vertrauenseigenschaften auf. Die hierbei zu Ungunsten des Verbrauchers bestehenden Informationsasymmetrien schaffen den Lebensmittelanbietern Spielraum für opportunisti-sches Verhalten, welches trotz bestehender Täuschungsschutzgesetze immer wieder zum Ob-jekt der öffentlichen Diskussion wird. Der vorliegende Beitrag analysiert die lebensmittelbe-zogene Verbraucher-Produzenten-Beziehung im Rahmen eines Prinzipal-Agenten-Modells. Dabei kann zunächst demonstriert werden, wie wichtig aus ökonomischer Perspektive die Ermittlung eines geeigneten Verbraucherleitbildes für die Täuschungsbekämpfung ist. Zudem wird gezeigt, dass eine verbraucherseitige Bestrafung subjektiver Täuschung, die mit LE-BENSMITTELKLARHEIT mittlerweile sogar institutionalisiert wurde, reduziert werden muss, um Täuschung zu verhindern.
