Colombia entre los TLC y la OMC: ¿liberación o administración del comercio internacional?

Abstract

La regulación de los mercados en el contexto de globalización económica día tras día trae nuevos retos y complejidades, hoy en el escenario de las guerras comerciales entre los grandes participantes del comercio internacional encontramos los interrogantes a los que se tratará de dar respuesta en este libro: ¿en qué condiciones se está participando en la liberalización del comercio, qué beneficios y costos para al Estado social de derecho se han derivado de esta liberalización? Para entender estos cuestionamientos, esta obra parte de una realidad de la globalización, la existencia de una mayor propensión a conflictos de normas u obligaciones en materia comercial, más específicamente del derecho de la OMC y los TLC celebrados por Colombia, con otras disposiciones del derecho internacional tales como normas medioambientales, de derechos humanos, laborales, comunitarias, regionales, etc. Aquí, la proliferación de instrumentos internacionales y su constante interacción, sin duda, hacen más difícil encontrar respuestas en un océano de obligaciones contenidas en tratados que normalmente son independientes entre sí y que tienen el mismo rango jurídico. Teniendo en cuenta lo anterior, en este libro se propone identificar algunas problemáticas del sistema de comercio internacional, o por lo menos aquellas que afectan a Colombia, V presenta algunas soluciones a partir de los principios sobre los cuales se erige este sistema, como el principio de no discriminación, sin olvidar los principios que son el fundamento de las relaciones internacionales en el Estado social de derecho colombiano, como los principios reciprocidad, equidad y conveniencia nacional.
