Les enjeux du débat sur la direcive service à la lumière des spécificités des services

Abstract

La libéralisation du commerce après s’être centrée sur les biens s’intéresse à présent aux services. Au niveau international les négociations de l’Uruguay Round avaient donné lieu à la création d’un accord spécial consacré aux services : l’AGCS (accord général sur le commerce des services) ou GATS en anglais (General Agreement on Trade in services), les négociations ont repris dans le cadre du Doha Round actuel. Dans l’UE, la stratégie de Lisbonne pour une relance du marché unique comporte un volet consacré aux échanges de services, volet qui s’est concrétisé par le projet de directive sur les services, dite Bolkestein. Dans les deux cas l’objectif est de faire disparaître les entraves au commerce des services pour en favoriser le commerce. La démarche engagée aussi bien dans l’UE qu’au niveau international a suscité de nombreuses réticences, elle pose également des problèmes économiques particuliers. En effet les réflexions économiques traditionnelles concernent indifféremment les biens et services, alors que les services connaissent des particularités qui doivent attirer l’attention.
