Abstract

A kutatás és a fejlesztés közvetlen állami támogatási eszközeinek visszaszorulása mögött a világgazdaságban nemcsak költségvetési szempontok állnak, hanem a versenytorzító állami beavatkozások korlátozása is. A csoportmentességi szabályozás elképzelése és gyakorlata azért született meg az Európai Unióban, mert ezzel az állam közvetlen pénzügyi közreműködése nélkül, a K+F-et végző cégek egyébként általában nem elfogadott piaci összejátszásának legalizálásával lehet a technikai fejlődést ösztönözni. Ez a szabályozási rendszer igen fontos elméleti kérdésekre hívja fel a figyelmet: ugyanis két fontos piacgazdasági alapelv ütközik össze benne, a piaci verseny szabadságának és a szellemi tulajdonhoz fűződő jogoknak a védelme. A tanulmány nem vállalkozik az Európai Unió csoportmentességi szabályozásának, illetve a most kialakulóban levő magyar csoportmentességi rendszernek az ismertetésére. Elsősorban a problémakör néhány fontosabb elméleti összefüggésére kívánja felhívni a figyelmet, és erre építve törekszik a K+F-politika hazai szakirodalomban eddig kevéssé tárgyalt piacelméleti hátterének elemzésére.
