Aufhebung der Tarifeinheit: Welche Folgen hat das Nebeneinander mehrerer Tarifverträge in einem Unternehmen?

Abstract

Gefährdet die Gründung von Spartengewerkschaften und das Nebeneinander von mehreren Tarifverträgen in einem Unternehmen die Stabilität der Arbeitsbeziehungen in Deutschland? Dieter Hundt, Präsident der Bundesvereinigung der Deutschen Arbeitgeberverbände, ist davon überzeugt, dass die Friedenspflicht ohne die Tarifeinheit in allen Branchen gefährdet ist. Denn ohne die Tarifeinheit seien Streiks möglich, obwohl im betroffenen Betrieb für alle Arbeitnehmer Tarifverträge bestehen. Damit gingen Spartenstreiks zu Lasten des gesamten Betriebs und der Belegschaftsmehrheit, und die bisherige Verlässlichkeit in den deutschen Arbeitsbeziehungen gehe verloren. Nach Ansicht von Hagen Lesch, Institut der deutschen Wirtschaft Köln, hängen die ökonomischen Auswirkungen eines Gewerkschaftswettbewerbs davon ab, ob die Gewerkschaften austauschbare oder komplementäre Arbeitnehmergruppen organisieren. Spartengewerkschaften sind mächtig, wenn sie komplementäre Berufsgruppen vertreten. Dann kann eine einzelne Gruppe den Produktionsablauf vollständig unterbrechen. Zudem sind die Tarifverhandlungen von Spartengewerkschaften oftmals konfliktintensiv. Sollte sich diese Konfliktorientierung fortsetzen, wird sich sowohl das Klima zwischen den Tarifparteien als auch das Klima zwischen den Gewerkschaften verschlechtern.
