Reform der Einschränkung der Urheberrechte in Lehre und Forschung — Abschätzung von Zahlungsbereitschaften für flexibleren Zugang zu studienrelevanter Literatur

Abstract

Zusammenfassung Das Gesetz über Urheberrecht und verwandte Schutzrechte (UrhG) begrenzt den Schutz des Urhebers beziehungsweise urheberrechtlich geschützter Werke in Fällen, in denen ein erhöhtes öffentliches Interesse am Zugang zu diesen Werken besteht. So regelt § 52a UrhG die öffentliche Zugänglichmachung von urheberrechtlich geschützten Werken im Rahmen von Unterricht und Forschung; § 52b UrhG beinhaltet Vorschriften zur digitalen Wiedergabe von geschützten Werken. Die gegenwärtig intensiv geführte Diskussion um eine Reform dieser beiden Regelungen ist vor allem von qualitativen Argumenten geprägt. Die vorliegende Arbeit präsentiert eine monetäre Bewertung der Auswirkungen, die sich auf Seiten von Studierenden bei einer Reform der genannten Paragraphen ergeben würden. Die Ergebnisse einer zu diesem Zweck durchgeführten kontingenten Bewertung (Contingent Valuation) zeigen, dass ein flexiblerer Zugang zu urheberrechtlich geschützten Materialien in der universitären Lehre und Forschung erhebliche positive Wohlfahrtseffekte erwarten lässt. Dieses Ergebnis ist nicht nur für politische Entscheidungsträger relevant, sondern auch vor allem für Urheber und Wissenschaftsverlage von hoher Bedeutung, da derzeit neue Mechanismen zum Ausgleich der Einschränkung ihrer Urheberrechte verhandelt werden.
