Analisi del nuovo settore affidato ad ARERA:il ciclo integrato dei rifiuti urbani

Abstract

Il dinamismo legislativo che caratterizza la gestione dei rifiuti continua a disorientare cittadini, imprese e pubblica amministrazione. Permangono molti dubbi interpretativi e coni d’ombra nella normativa, che rischiano di compromettere la corretta gestione dei rifiuti e, conseguentemente, di veder disatteso il fine ambientale con cui la normativa è nata. La confusione rischia di danneggiare, peraltro, il lavoro e l’autorevolezza degli organi di controllo che si trovano spesso costretti ad interpretare il disposto normativo, in modo discordante e contradditorio sul territorio. Chiarezza e certezza delle regole per la gestione dei rifiuti sono, infatti, condizioni indispensabili per: assicurare la corretta applicazione del quadro normativo; premiare le imprese virtuose penalizzando quelle che commettono reati e, al tempo stesso, garantire una gestione efficace ed efficiente alle imprese evitando di appesantirle con nuovi tributi e carichi burocratici inutili. Senza un’azione semplificatoria e chiarificatrice, senza percorsi di aggregazione capaci di superare la significativa frammentazione territoriale e senza un assetto istituzionale e normativo coerente nel definire regole, attribuire responsabilità, ruoli e competenze, l’Italia non riuscirà a perseguire la tutela dell’ambiente, a emanciparsi dal ricorso alla discarica né a effettuare la transizione verso un’economia circolare. In questo contesto, con la Legge di Bilancio 2018, all’articolo 1 commi 527-530, sono state affidate funzioni di regolazione e controllo nel settore dei rifiuti urbani e assimilati all’Autorità di Regolazione di Energia, Reti e Ambiente (ARERA).
