Popular pressure, mock compliance or leadership as distraction: the UK’s approach to beneficial ownership transparency

Abstract

Since the 2008 financial crisis, the United Kingdom (UK) has positioned itself as a global leader in beneficial ownership transparency, pioneering public registers of UK companies and of overseas companies that own real estate. This paper asks what is behind the UK’s leadership approach, in particular as it seems like a risk to its powerful wealth management center. Based on an analysis of consultation submissions and semi-structured interviews, the paper finds that the UK’s leadership occurred in a context of significant popular pressure and salience, which however cannot alone explain the leadership approach. Demonstrating that mock compliance does not fit the case either, this paper puts forward the concept of ‘leadership as distraction’. It describes when a country steers certain reforms to distract from other – more undesirable – ones, using the reputational benefits of leadership to shield other areas from reform. Understanding the dynamics of leadership as distraction opens up a different perspective on how governments reconcile pressures to abide by international standards with protecting important economic sectors.
