Ausweitung selektivvertraglicher Versorgung: Auswirkungen auf die Gesundheitsversorgung und Anforderungen an den zukünftigen regulatorischen Rahmen

Abstract

In dieser Studie werden die wesentlichen Regelungen zu Gunsten von Gesundheit und Erwerbsfähigkeit Beschäftigter mit dem in Betrieben vorhandenen Wissen verglichen. Zunächst wurden alle begünstigenden Rechtsvorschriften erfasst, egal ob im selbstverwalteten Sozialversicherungs- oder im staatlichen Arbeitsschutzrecht. Einbezogen wurden tarifliche und andere Regelungen der Sozialpartner. Darauf folgte eine Erkundung der Methoden, mit denen Sozialversicherungsträger und Arbeitsschutzbehörden ihren Verpflichtungen nachkommen. Gespräche mit Experten der Träger und des staatlichen Arbeitsschutzes sowie in Gewerkschaften und Arbeitgeberverbänden konkretisierten das Bild. In einem weiteren Schritt wurde ermittelt, in welchem Umfang dieses soziale Netz in den Betrieben und damit bei den Beschäftigten bekannt ist. Dazu wurden exemplarisch je zehn kleine und mittlere Betriebe in Hamburg, Mecklenburg-Vorpommern und Schleswig-Holstein ausgewählt und befragt.Diese Bausteine wurden mit den Gesetzesvorgaben gespiegelt, Defizite und Überschneidungen herausgearbeitet und Verbesserungsvorschläge entwickelt. Über die Studie hinaus werden sie in fachpolitische Diskussionen eingebracht und der Realisierung zugeführt.
