Abstract

La teoría general del derecho que aquí se tratará es la disciplina que, en el seno de la filosofía del derecho, tiene por objeto permi tir un trabajo científico sobre el derecho. Es evidente que los términos que se acaban de emplear deberán precisarse mejor, pues su uso por juristas y filósofos es relativamente fluctuante. Desde ahora se le advierte al lector que la concepción de la teoría general del derecho así producida tiene definiciones concurrentes, pues estas reposan sobre otros fundamentos. De ahí que a quien proponga cierta concepción de esta disciplina le corresponde siempre justificar su aproximación a ella.Dentro de la perspectiva retenida para efectos de este trabajo, el objeto de la teoría general del derecho no es (de inmediato) el derecho, sino más bien el discurso producido a propósito del derecho, llamado dogmática jurídica o doctrina. Esta última expresión no reenvía a un cuerpo profesionalizado, en particular universitario, pues más bien designa un conjunto de opiniones que tienen por objeto el derecho, sea lo que fuere que se entiende por tal y cualquiera que sea el esta tus de quien emite dichas opiniones.
