Contratos de transferencia de tecnología y crecimiento de la economía española: 1959-1972

Abstract

La transferencia de tecnología es uno de los factores más importantes para que los países relativamente atrasados pueden converger con los países más avanzados. En este aspecto es deseable que los países más atrasados copien la tecnología de aquellas naciones con un alto nivel tecnológico. Por otro lado, algunos investigadores han afirmado que la copia de tecnología foránea crea una situación de dependencia que puede dañar al país imitador. En este artículo se pretende demostrar que las condiciones que aparecen en los contratos de transferencia de tecnología que firmó la economía española en los años sesenta no pueden ser interpretadas como cláusulas restrictivas. Los estudios recientes sobre la transferencia de tecnología muestran que dichas cláusulas aparecen en cualquier contrato de transferencia de tecnología que se firme, y son condiciones formales, dada la peculiaridad del objeto del contrato: la transmisión del conocimiento.
