Corruzione, malcostume amministrativo e strategie etiche.Il ruolo dei codici

Abstract

La discrezionalita' e' un elemento ineludibile dell'azione amministrativa. Essa deriva dall'incompletezza dei contratti e dalle asimmetrie informative che caratterizzano ogni relazione di agenzia. Pur costituendo una risorsa di crescente rilievo dei sistemi amministrativi pubblici, la discrezionalita' dei civil servants incrementa le possibilita' di abuso di potere e di collusione. Si pone percio' il problema di tenerne sotto controllo le possibili degenerazioni in termini di malcomportamento amministrativo e di corruzione senza inibirne le potenzialita' positive. Allo scopo e' ipotizzabile una combinazione di strategie istituzionali e organizzative e di strategie etiche. In questo quadro un ruolo significativo puo' essere svolto dai codici etici o di condotta, in quanto strumenti di guida e di controllo del comportamento dei pubblici funzionari. I codici definiscono un sistema di incentivi morali e reputazionali, in aggiunta alle sanzioni penali e amministrative, rivolti a incrementare il capitale etico delle amministrazioni e a presidiarne le "zone grigie" non adeguatamente normate dai contratti. L'utilita' dei codici e la loro attitudine a favorire una "discrezionalita' responsabile" dipendono sia dalla loro corretta implementazione e da un'equa applicazione sostenuta da organismi indipendenti, sia dalla loro integrazione in piu' generali strategie di riforma amministrativa basate su incentivi positivi e su sanzioni.
