Implementation of Innovative Engineering Solutions in Moldova Through the Prism of the Existing Legal Framework

Abstract

The protection of the environment through the realization of sustainable development objectives represents a national priority for the Republic of Moldova. Polluter pays principle and precautionary principles are clearly stated across special laws on environmental sub-domains. Implementation of innovative engineering solutions in Moldova presumes that the imported equipment does comply with the country’s legal framework as a result of embracing custom requirements. Typically, such equipment belongs to a category with an established implementation path. However, how will be stated the legal arguments for authorizing the implementation of innovative engineering solutions that do not have clear established norms? It was observed that there are a few categories of an institutional void within in the environmental legislative and enforcement domain: (a) absence of a legal framework for targeted sub-domain; (b) absence of parameters for a specific item or activity; (c) insufficient characteristics of an item; (d) regulatory dissonance; and (e) institutional dissonance. This paper discusses the modalities for achieving legal consensus regarding the implementation of environmental innovations, because the equipment of higher efficiency, unprecedented innovations, or untraditional methods must also be framed within permitting standards. In conclusion, the path to adopt modification in regulatory framework begins with the identification of the corresponding level of normative acts that can facilitate the implementation of innovative engineering solutions.
