La conciliación en el derecho administrativo colombiano

Abstract

Colombia ha conocido un periodo de transformación institucional y jurídica desde la expedición de la Constitución de 1991. Fue con dicho texto normativo que se confirió rango constitucional a la conciliación, y es en ese contexto con el que comienza el desarrollo reciente de la misma y se ha manifestado la voluntad del gobierno nacional y del legislativo mediante las diferentes normas expedidas con el fin de promover su utilización. Ahora bien, a pesar de que la conciliación en el derecho administrativo colombiano se encuentra regulada por la normatividad en vigor, su eficacia no ha sido garantizada. Factores externos al propio mecanismo como, por ejemplo, los vacíos normativos existentes, las interpretaciones algunas veces desafortunadas de los textos normativos, la falta de compresión del mecanismo por parte de los intervinientes, así como las formalidades a las cuales está sometida su utilización, y la corrupción, han afectado directamente el funcionamiento de la conciliación en el derecho administrativo y su eficacia. Hoy, después de casi 26 años de consagración constitucional, este libro busca abordar la conciliación desde un punto de vista crítico, con el fin de analizar sus bondades no solo como mecanismo que permite resolver por fuera de los estrados judiciales los conflictos sino como un mecanismo cuya eficacia debe ser garantizada con el fin de promover y asegurar el principio de participación, de igual manera, la paz, la tranquilidad, la armonía en las relaciones sociales y la justicia social, tan necesarias en nuestro país. Las reflexiones que en esta obra se realizan sobre la conciliación van más allá de su simple análisis normativo y buscan ante todo crear en el lector una visión amplia de la conciliación, de su importancia, de la necesidad de reformas normativas, de políticas públicas adecuadas y de la construcción de una cultura a favor de su utilización en el derecho administrativo, la cual no se ha consolidado en Colombia y que es absolutamente necesaria para lograr su eficacia.
