Branchenspezifische Interessen an der Allgemeinverbindlicherklärung in Deutschland
[Explaining sector-specific interests in the extension of collective bargaining agreements in Germany]

Abstract

Die Allgemeinverbindlicherklärung von Tarifverträgen (AVE) kann ein Mittel darstellen, die Tarifbindung zu stabilisieren. Inzwischen ist viel über die AVE-Praxis einzelner Länder bekannt, wenig jedoch über die AVE auf Branchenebene. Der Beitrag untersucht die Verteilung der AVE zwischen Branchen in Deutschland. In einem most-similar-design vergleicht er, wie Arbeitgeberverbände und Gewerkschaften im Baugewerbe, im Einzelhandel und im Wach- und Sicherheitsgewerbe mit der AVE umgehen und welche Interessen sie dabei verfolgen. Datenbasis sind die offiziellen AVE-Verzeichnisse, Verbandspublikationen und Interviews mit Vertreterinnen und Vertretern von Gewerkschaften und Arbeitgeberverbänden. Es wird herausgearbeitet, dass die Akteure deshalb ein Interesse an der AVE haben, weil das Instrument Unterbietungswettbewerb einzudämmen hilft. Ob sich das Interesse durchsetzt, hängt allerdings ab von strategischen verbandspolitischen Entscheidungen. Darüber hinaus bestehen branchenspezifische Motive wie der Schutz der sozialpartnerschaftlichen Sozialkassen im Baugewerbe oder das Bemühen im Wach- und Sicherheitsgewerbe, die Attraktivität der Branche zu steigern. Im Einzelhandel führten hingegen die Unzufriedenheit mit bestehenden Tarifinstitutionen sowie hohe Wettbewerbsintensität zur Auflösung der Tarifbindung, der AVE und damit der klassenübergreifenden Koalition.
