Sozial- und tarifpolitische Bedeutung der Allgemeinverbindlicherklärung von Tarifverträgen im Baugewerbe

Abstract

Das Baugewerbe ist der Wirtschaftsbereich mit der größten Zahl von allgemeinverbindlichen Tarifverträgen. Die statistische Übersicht des Tarifregisters beim Bundesarbeitsministerium weist für das Baugewerbe im Jahr 2011 insgesamt 202 gültige allgemeinverbindliche Verträge aus. Die meisten davon betreffen die Bereiche berufliche Bildung, Altersversorgung und andere sozialpolitische Regelungen sowie ihre Durchführung.Der Beitrag arbeitet die Bedeutung dieser Allgemeinverbindlicherklärungen (AVE) für die Tarifpolitik und die sozialpolitische Regulierung in dieser Branche aus Sicht der Industriegewerkschaft Bauen-Agrar-Umwelt (IG BAU) heraus. Hierfür werden die historische Entwicklung des Flächentarifvertrages im Bausektor wie auch die Besonderheiten dieser Branche kurz skizziert. In einem zweiten Schritt geht es – sozusagen ex negativo – um die daraus resultierende Bedeutung der AVE im Baugewerbe, einschließlich der Situation im Baunebengewerbe. Abschließend werden aktuelle Entwicklungen und Probleme beleuchtet, mit denen sich das Baugewerbe seit einiger Zeit hinsichtlich der AVE ihrer Tarifverträge konfrontiert sieht.
