Regulation of trade policy of a private company: theory, practice and implications for antitrust

Abstract

The applied and theoretical aspects of antimonopoly regulation of trade policies of private companies, including the competition authority opened the available alternative instruments regulating trade policies and their possible applications. Through the prism of the selection mechanism of transaction management presented the possible effects of anti-monopoly regulation of trade policy. It is shown that the emerging practice of antitrust regulation of trade policies of private companies shows bias towards the Russian Antitrust economic regulation. One of the results of the implementation of regulation of the designated trade practices - the effect of "creeping regulation". The intervention of the antitrust authorities in the activities of a single economic entity may result from substituting its task: instead of protecting and creating conditions for the development of competition authority deals with the protection of the interests of certain groups of consumers, ensure the satisfaction of their demands and conditions of interaction with the individual business entity. The use of tools of the economic theory of transaction costs can cause a depletion effect of structural alternatives of transaction management.
