Abstract

[eng] Contract, authority and trust : can the subcontracting relationship be compared with the employment relationship ?. . The aim of the article is to compare the subcontracting relationship with the employer/ employee relationship through the study of the coordination mechanisms wich influence these two types of relationships. Indeed, in both cases one finds oneself faced with what is called in French an « economie de la qualite » (economy of quality), in others words with a situation in wich questions of quality are involved and where there exists a relative uncertainty concerning the effort wich will be made by the employee or the subcontractor to meet the demand for quality. The text raises the question of wether or not it is possible to validate the explicit and implicit promises written into the contracts governing employaient and subcontracting. Since the latter prove to be incomplete, the author analyses the underlying mechanisms brought into play in the establishing of an agreement between the parties involved in transactions of these types. This process relies, on the one hand, on a authority relation, and on the other hand, on a trust relation.. 961 [fre] Contrat, autorité et confiance. L'article se propose d'effectuer un rapprochement entre relation de sous-traitance et relation d'emploi, à travers l'étude des mécanismes de coordination qui gouvernent ces deux types de relation. En effet, dans les deux cas, nous nous trouvons confronté à une « économie de la qualité », en situation d'incertitude sur l'effort du salarié et du sous-traitant. Le texte s'interroge ainsi sur la possibilité de valider les promesses explicites et implicites inscrites dans le contrat de travail et le contrat de sous-traitance. Ces derniers se révélant incomplets, l'auteur analyse les mécanismes sous-jacents au contrat qui interviennent dans la production de l'accord entre les « transactants ». Cette production repose, d'une part, sur une relation d'autorité, et, d'autre part, sur une économie de la confiance.
