Funktionale Separierung als strategisches Regulierungsinstrument auf dem europäischen Telekommunikationsmarkt

Abstract

Maßnahmen der Marktstrukturregulierung zählen zu jenen Regulierungsinstrumenten, die in Netzsektoren neben Zugangsregelungen und Vorgaben für die Nutzung von Leistungen Anwendung finden. Sie können unterschiedliche Intensitätsgrade aufweisen, die mit entsprechend starken Eingriffen in die Verfügungsrechte von Unternehmen korrespondieren. Im aktuellen Prozess der Liberalisierung von Netzsektoren in der Europäischen Union haben die Diskussion sowie die Vorgabe entsprechender Maßnahmen zunehmend Bedeutung gewonnen, regelmäßig vor dem Hintergrund einer als zu langsam eingeschätzten Herausbildung von wettbewerblichen Strukturen. Nach eigentumsrechtlichen Separierungsmaßnahmen bei Strom und Gas ist auf der europäischen Ebene die funktionale Separierung auf den Telekommunikationsmärkten zu einem Thema geworden. Zwar ist die Entscheidungsfindung noch nicht abgeschlossen, dennoch liegen bereits erste Erfahrungen mit freiwilligen Akten der Separierung in einigen Ländern der Europäischen Union vor. Christian Harnisch stellt in diesem IfG-Arbeitspapier diese Fälle vor, nachdem er aus einem spieltheoretischen Modell, in dem die Optionen der Regulierungsbehörden berücksichtigt werden, Hypothesen über die Wirksamkeit hinsichtlich der Herausbildung von Wettbewerb abgeleitet hat. Er analysiert die Entwicklungen im aktuellen technischen Umfeld, das sich derzeit grundsätzlich in Bewegung befindet. Sein wichtigstes Ergebnis besteht darin, dass unter Berücksichtigung des politischen und regulatorischen Umfeldes funktionale Separierungsmaßnahmen als ein strategisches Instrument gehandhabt werden sollten. Dies bedeutet, dass bereits die Möglichkeit einer freiwilligen Umsetzung in der Lage ist, Wettbewerbsprozesse in Gang zu bringen oder zu intensivieren. Diese Überlegungen sollen hiermit zur Diskussion gestellt werden. Das Arbeitspapier ist in den IfG-Forschungscluster I: Institutionenökonomische Analysen einzuordnen.
