Außergewöhnliche Notsituation und Sondervermögen "Transformationsfonds Saarland" ökonomisch plausibel

Abstract

Der Antrag zielt auf die Feststellung einer Notlage in Anwendung der Notfallklausel des Art. 109 Abs. 3 Satz 2 GG und des § 2 Abs. 1 HStabG sowie die Errichtung eines im Wesentlichen kreditfinanzierten Transformationsfonds in Form eines Sondervermögens ohne eigene Kreditermächtigung in Höhe von bis zu 3 Mrd. € zur Bewältigung des anstehenden Strukturwandels ab. Nach Korioth/Müller (2022) und Rechnungshof des Saarlandes (2022) kommt es aus juristischer Perspektive entscheidend darauf an, dass die Feststellung der Notlage ebenso wie die Geeignetheit der zur Behebung der Notlage vorgesehenen Maßnahmen ausführlich und nachvollziehbar begründet wird. Im Folgenden wird kurz aus ökonomischer Sicht auf die Begründbarkeit eingegangen. Dabei werden neben der Begründung durch Landesregierung und SPD-Fraktion sowie die im Auftrag der Landesregierung erstellten Studien (DIW Econ 2022 und Falck/Pfaffl 2022) auch einige Jahresgutachten des Sachverständigenrates sowie weitere Quellen herangezogen. Insgesamt lassen sich auf dieser Grundlage sowohl die Feststellung der Notlage als auch grundsätzlich die geplante Verwendung der Mittel des Sondervermögens zur Bekämpfung der Notlage ökonomisch plausibel begründen.
