Die Aufsichtsratsluecke im Dienstleistungssektor. Ausmass und Bestimmungsgruende (Missing Supervisory Boards in the Service Sector. Dimensions and Determinants)

In Deutschland sind die Aufsichtsratsbildung sowie die damit einhergehende Arbeitnehmermitbestimmung abhaengig von der Rechtsform und Firmengroesse gesetzlich vorgeschrieben. Die vorliegende Arbeit demonstriert, dass entgegen den rechtskraeftigen Regelungen weniger als die Haelfte aller GmbHs im westdeutschen Dienstleistungssektor mit 500 bis 2000 Beschaeftigten einen Aufsichtsrat und folglich Mitbestimmung auf Unternehmensebene aufweisen. Um die ermittelte Aufsichtsratsluecke erklaeren zu koennen wird eine oekonometrische Analyse potenzieller Bestimmungsgruende fuer das verbreitete Fehlen durchgefuehrt. Diese demonstriert den Einfluss verschiedener Variablen auf die Existenz des Organs. Es wird gezeigt, dass sich sowohl die Organisationsform des Hauptgesellschafters als auch die Beschaeftigtenzahl auf die Wahrscheinlichkeit des Bestehens eines Aufsichtsrats auswirken. Das Unternehmensalter spielt als Einflussgroesse hingegen keine wichtige Rolle.
