Urheberrecht und Digitalisierung - Eine Zwischenbilanz

Abstract

Das Internet und die Digitalisierung haben die Film-, Musik-, und Literaturbranche wesentlich verändert. Zum einen produktionsseitig, wo vor allem bei technisch aufwändigen Projekten der Zugang zu Produktionsmitteln wesentlich erleichtert und verbilligt wurde, zum anderen auf der Verwertungsseite. Die Veränderungen auf der Produktionsseite zusammenzufassen, ist wenig zielführend, da sie branchenspezifisch und regional großen Unterschieden unterliegen. Die Veränderungen und Probleme auf der Verwertungsseite ähneln einander quer durch die Branchen und Regionen, wenngleich sie auch nicht ident sind. In dem vorliegenden Artikel werden diese Probleme, die sich aus dem für analoge Zwecke konzipierten Urheberrecht in der digitalen Welt ergeben, unter ökonomischen Gesichtspunkten umrissen und Lösungsansätze diskutiert.
