Dürfen europäische Gesetze Grundfreiheiten einschränken?

Abstract

Ist der Unionsgesetzgeber an die Grundfreiheiten gebunden? Darf er Maßnahmen, die auf mitgliedstaatlicher Ebene verbotene Beschränkungen der Binnenmarktfreiheiten wären, EU-weit harmonisieren? Und darf er mitgliedstaatliche Maßnahmen mittels Sekundärrecht autorisieren, die ansonsten in Konflikt mit den Marktfreiheiten geraten würden? In der europarechtlichen Fachliteratur gehen die Einschätzungen weit auseinander. Zur Klärung werden zwei Konfliktsequenzen analysiert: die Auseinandersetzungen um die Richtlinie zum Verbot von Tabakwerbung und um die Entsenderichtlinie einschließlich ihrer jüngsten Revision. Es zeigt sich, dass der Unionsgesetzgeber an die Grundfreiheiten gebunden ist. Es handelt sich jedoch um eine lockere Bindung mit bisher unklaren Konturen. Der europäische Gesetzgeber sollte die unklaren Grenzen des ihm zugewiesenen Ermessensspielraums offensiv und mutig testen.
