El derecho internacional de inversión extranjera y la industria extractiva. estándares internacionales en el sector extractivo

Abstract

La industria extractiva y el Derecho internacional de inversiones, en su operatividad, tienen que encontrarse con el Derecho nacional del Estado de acogida de la inversión, ya sea de Derecho civil o de Derecho anglosajón, algunos estables, otros variables, algunos proinversor otros proEstado. Al mismo tiempo, el sector global de las industrias extractivas es, a nivel internacional, regulado por medio de pautas cuyas cuestiones crean los aspectos fundamentales en el alcance de las obligaciones en los tratados de inversiones, de las resoluciones en las controversias de dichos tratados resueltas mediante arbitraje internacional y por ende de la creación del Derecho internacional de inversiones. El libro responde a los estándares internacionales que han sido identificados por los actores de la industria extractiva. Los estándares internacionales sirven como marco de la mejor práctica, tendientes a obtener un cambio y desarrollo sostenibles en la industria minera, energética, petrolera y metalúrgica. Tales estándares han sido creados con el objetivo de que todas las compañías -miembros y no miembros de las distintas instituciones o entidades que los promueven-los implementen como principios completos y de manera trasparente en el reporte de sus actividades.
