Die ILO-Standards zum Schutz von Arbeitnehmerrechten – Ein Begruendungsversuch mit Hilfe der kantischen Position von Norman E. Bowie (The ILO’s Labour Standards for the Protection of Employee Rights – An Analysis Based on Norman E. Bowie’s Kantian Perspective on Business Ethics)

Abstract

Der Beitrag ergruendet die normativen Grundlagen der Standards zum Schutz der Arbeitnehmerrechte der International Labour Organization. Auf Basis der kantischen Position des US-amerikanischen Wirtschaftsethikers Norman E. Bowie zeigen die Autoren, dass sich Bowies Theorieansatz grundsaetzlich dazu eignet, die vier Kernbereiche der ILO-Aktivitaeten ethisch zu fundieren. Jedoch stoesst Bowies Position bei der Begruendung der ILO-Standards auch auf Grenzen, die nur teilweise mittels zusaetzlicher, mit der kantischen Stossrichtung vereinbarer Ideen erweitert werden koennen. So wird beispielsweise der republikanische Freiheitsbegriff Philip Pettits als Verfeinerung der teilweise problematischen Unterscheidung Bowies zwischen negativer und positiver Freiheit vorgeschlagen. Kritisch bleiben die Themen Schutz von Kindern, Nichtdiskriminierung und Gewerkschaften. Alles in allem liefert der Beitrag eine ganzheitliche und grundsaetzlich positive Antwort auf die Frage nach der Moeglichkeit einer kantischen Begruendung der ILO-Standards. (The article aims at exploring the normative basis of the International Labour Organization’s labour standards. Based on Norman E. Bowie’s Kantian perspective on Business Ethics the authors show that Bowie’s theoretical groundwork can in principle be used to ethically justify the four core areas of the ILO’s activities. However, they also discover the limitations of Bowie’s position which can only sometimes be overcome by additional concepts compatible with the overall Kantian thrust. For exam-ple, Philip Pettit’s conception of republican freedom is proposed as a refinement of Bowie’s partly problematic distinction between negative and positive freedom. There remain some critical aspects in the fields of protection of children, non-discrimination, and labour unions. All things combined the article provides an overall and cautiously affirmative picture concerning the possibility of grounding the ILO’s labour standards in Kantian concepts)
