L?incerto percorso della legislazione in favore della montagna in Italia e nuove prospettive di attenzione al "territorio"

Abstract

I territori montani sono oggetto d?attenzione da parte del legislatore nazionale fin dai primi del ?900 e con l?approvazione dell?art. 44 della Costituzione, diventano destinatari di un preciso "impegno costituzionale". Nell?immediato dopoguerra, infatti, la necessit? di mantenere in tali zone una vitalit? socio-economica, nonostante le difficili condizioni ambientali, era tale da far avvertire la situazione dei territori montani come "una questione politica nazionale". Tre leggi specifiche, emanate a circa vent?anni l?una dall?altra, provarono a rispondere, con visioni e strumenti diversi, alle esigenze di quei territori senza tuttavia raggiungere i risultati sperati. Dopo di allora sembra assistersi, da parte delle istituzioni nazionali, ad una progressiva perdita di interesse per la montagna e alla fine di una politica nazionale in suo favore. Dall?analisi di alcuni recenti provvedimenti nazionali, di natura legislativa e programmatica, che hanno come destinatari anche i territori montani, l?A. rileva la recente tendenza non tanto al "disinteresse" nei confronti dei territori montani, quanto, piuttosto, alla perdita di "specificit?" degli stessi; la "montagna" non rileva pi? in quanto tale come oggetto specifico degno d?attenzione da parte dell?ordinamento giuridico. La fine di una politica specifica per la montagna potrebbe costituire l?occasione per superare i limiti del passato e pensare a strumenti che sappiano cogliere l?elevata differenziazione interna alle aree montane e tengano conto delle loro diversit? pi? che dei tratti comuni.
