Konstitutionenökonomische Überlegungen zum Konzept der Wettbewerbsfreiheit

Abstract

Within the ordoliberal tradition the „freedom-to-compete“ concept plays a central role as guide line for competition policy. Its precise meaning and normative content are, however, not entirely unambiguous. The purpose of this article is to analyze some of the ambiguities surrounding the „freedom-to-compete“ concept from a constitutional economics perspective and to argue that these ambiguities can be eliminated if a careful distinction is drawn between the constitutional and the sub-constitutional meaning of the concept.
