Abstract

-- Based on economic bargaining theory and the theory of competitive markets, the paper operationalizes the legal term ?absence of contract parity?. It is argued under which circumstances the absence of contract parity calls for regulative action. Regulation of contracts and constitutional policy are analyzed as potential remedies.
