Die Assoziierungsabkommen mit der CSFR, Polen und Ungarn: wegweisend oder abweisend?

Abstract

In den Assoziierungsabkommen mit der CSFR, Polen und Ungarn bietet die Europäische Gemeinschaft weit mehr Marktöffnung, technische Kooperation und ordnungspolitische Orientierungshilfe an als bisher in allen bilateralen Handels- und Kooperationsabkommen mit Drittländern. Die Abkommen können dazu beitragen, die Hände der Regierungen der drei Staaten gegen Forderungen heimischer Lobbygruppen nach Aufweichung des Reformkurses zu binden. Damit würde die internationale Glaubwürdigkeit der Reformpolitik und somit auch die Kreditwürdigkeit der Staaten auf den Weltkapitalmärkten gestärkt. Den Maßstab bilateraler Freihandelsabkommen erfüllen die Abkommen jedoch bei weitem nicht. In den für die drei Staaten wichtigen Sektoren, insbesondere der Landwirtschaft, sehen die Abkommen nicht mehr vor als Marktzugangsvorteile gegenüber Drittländern. Schwachstellen im Vertrag sind, daß er für die drei Länder Erziehungszollmaßnahmen und schwammige Schutzklauseln vorsieht. Wichtige Dienstleistungsbranchen wie Banken und Versicherungen in der CSFR, Polen und Ungarn werden gegen die Konkurrenz aus der Gemeinschaft gestützt. Zudem bleibt Angehörigen aus der Gemeinschaft der Zugang zu Grund und Boden in Mittel- und Osteuropa weitgehend verschlossen. Dies ist ein nicht unbedeutendes Investitionshemmnis. Aber auch die Offerten der Gemeinschaft bei der Freizügigkeit der Arbeitskräfte sind kleinlich. Als Handelswirkung sind in erster Linie umlenkende Effekte zu Lasten der Anbieter aus Drittländern und nicht handelschaffende Wirkungen zu erwarten. Ob die Abkommen mit der GATT-Ausnahmeregel für Freihandelszonen vereinbar sind, ist umstritten. Ein Urteil darüber wird sich im wesentlichen auf die Liberalisierungsmaßnahmen der Vertragspartner im Rahmen der Uruguay-Runde stützen müssen.
