Abstract

D'un point de vue empirique, les communs sont observés en Afrique subsaharienne dans de nombreux domaines et ne sont pas marginaux. Sur les enjeux fonciers et de gestion des ressources naturelles, les communs africains sont le prolongement de formes traditionnelles que des communautés mobilisent et adaptent aux conditions contemporaines. Les activités économiques et les logiques marchandes y sont subordonnées aux relations sociales et aux interdépendances écologiques. Dans un contexte marqué par une pluralité juridique et une fréquente concurrence entre les acteurs de la régulation foncière, la sécurisation de ces communs dépend de la garantie des droits d'usages, de la pertinence et de l'effectivité des règles et de la clarté du cadre institutionnel dans lequel ils s'inscrivent.
