Abstract

El transporte ferroviario de pasajeros resulta fundamental para la sostenibilidad económica y medioambiental y para la cohesión social y territorial. Este estudio identifica posibles barreras que pueden afectar al proceso de apertura a la competencia de los servicios sujetos a obligaciones de servicio público (OSP). Para minimizar esos obstáculos y asegurar que se materializan los beneficios potenciales de la apertura, se recomienda, primero, adoptar un enfoque procompetitivo en la aplicación de la normativa en cuanto a la declaración de OSP y su adjudicación, de acuerdo con un calendario ambicioso. Segundo, establecer un marco institucional adecuado, desvinculando a los operadores públicos que prestan servicios de los gestores de la infraestructura y las autoridades licitadoras, al tiempo que se refuerza la supervisión independiente del proceso. Tercero, asegurar que los nuevos operadores pueden acceder a los insumos relevantes (entre otros, la infraestructura, el material rodante, los talleres, el personal de conducción) y la información necesaria para competir de forma efectiva.
