El derecho de la competencia y las licencias FRAND : herramientas para el acceso a invenciones

Abstract

Es innegable la importancia que ha cobrado en las últimas dos décadas la explotación de los derechos de propiedad intelectual en las economías, ya no solamente de países desarrollados, sino también en aquellos en vías de desarrollo. Aunque las líneas que separaban a los países productores de tecnología de los receptores de tecnología se han tornado cada vez más difusas, es indiscutible que persisten las asimetrías en las relaciones contractuales entre los titulares de derechos de propiedad intelectual y los interesados en obtener o beneficiarse del conocimiento que protegen dichos derechos. Un importante sector de la doctrina ha sostenido que el Derecho de la competencia y el de la propiedad intelectual, lejos de ser dos disciplinas antagónicas, son las dos caras de una misma moneda, puesto que, a pesar de que este último crea derechos de explotación exclusiva, el primero debe ser el encargado de la regulación del ejercicio de estos "monopolios" para que no causen distorsiones económicas o incluso para que no afecten a la sociedad en general.
