Betriebsraete und Strukturwandel

Abstract

Strukturelle Veraenderungen sind ein Kennzeichen der Marktwirtschaft, gesetzliche Regelungen spiegeln haeufig nur die Notwendigkeiten zu einem bestimmten Zeitpunkt wider und werden obsolet bzw. sind aenderungsbeduerftig. Der vorliegende Artikel gibt zunaechst einen kurzen UEberblick ueber die Veraenderungen der Wirtschaftsstruktur der letzten Jahrzehnte. Nach einer UEbersicht der Argumente, warum gesetzliche Mitbestimmungsregeln ueberhaupt notwendig sein koennen, folgt eine Analyse der Wirkungen, die der Strukturwandel auf die bestehenden Betriebsratsgesetze ausuebt. Schliesslich wird betrachtet, welche Auswirkungen der Strukturwandel auf die Notwendigkeit der gesetzlichen Regelung der betrieblichen Mitbestimmung hat. Insgesamt sinkt die theoretische Rechtfertigung der Notwendigkeit gesetzlicher Regelungen durch die strukturellen Veraenderungen.
