Construcción social y política de los derechos a la justicia y la paz en el marco de la justicia transicional en Colombia, a partir del análisis de la experiencia de otros países

Abstract

La investigación de la cual se desprende este artículo tiene como objetivo definir los conceptos de paz y de justicia para Colombia, a partir del análisis de la experiencia de otros países. Teniendo en cuenta este objetivo, el presente artículo busca exponer la evolución del concepto de justicia transicional, atado a las transformaciones históricas y a las particularidades de las sociedades donde se aplica. Dado lo anterior, se analizan los contenidos o imaginarios que desde otros países se han dado a los conceptos de justicia, verdad y paz, y se hace un estudio del marco normativo y jurisprudencial en Colombia.
