Diskriminierende Gebotsbeschränkungen im deutschen Großhandelsmarkt für Strom: Eine wettbewerbsökonomische Analyse

Abstract

Im Rahmen der Sektoruntersuchung des Großhandelsmarktes für Strom hat das Bundeskartellamt 2011 die Auffassung dargelegt, dass marktbeherrschende Unternehmen keine Preisgebote oberhalb der Grenzkosten abgeben dürfen. In dem vorliegenden Beitrag werden die Auswirkungen einer solchen Gebotsbeschränkung aus wettbewerbsökonomischer Perspektive erörtert. Im Ergebnis ist eine implizite Gebotsbeschränkung aus wettbewerbsökonomischer Sicht nicht nur ein unverhältnismäßiger und diskriminierender Eingriff, sondern auch mit dem Risiko adverser ökonomischer Konsequenzen verbunden, da zum einen Investitionsanreize für marktbeherrschende Unternehmen reduziert werden, zum anderen sich aber zugleich eine marktverschließende Wirkung für Wettbewerber ergibt. Ökonomisch völlig unhaltbar ist die Auffassung, dass ein Preisaufschlag auf die Grenzkosten nur zu rechtfertigen sei, wenn das marktbeherrschende Unternehmen ansonsten seine totalen Durchschnittskosten, bezogen auf das gesamte Kraftwerksportfolio, nicht erwirtschaften kann. Damit wird eine ansonsten regelmäßig als wettbewerbswidrig angesehene Quersubventionierung durch marktbeherrschende Unternehmen mit entsprechenden Marktverschlusseffekten geradezu induziert und der Wettbewerb strukturell gebremst. Des Weiteren wird die aktuelle Marktabgrenzung des Großhandelsmarktes für Strom analysiert und die Auswirkung auf das implizit ausgesprochene Preisaufschlagsverbot dargestellt, da insbesondere das Market Coupling in jüngerer Zeit zu signifikanten Veränderungen geführt hat. Aus der zunehmenden Integration der Großhandelsmärkte über nationale Grenzen hinweg ergeben sich weitere Probleme für derartige Gebotsbeschränkungen.
