Institutionelle Gestaltungsmöglichkeiten zur Erleichterung des LDC-Portefeuille-Managements der Gläubigerbanken

Abstract

In diesem Beitrag werden kreditpolitische Maßnahmen erörtert, die zu einer Entschärfung der internationalen Schuldenkrise beitragen könnten. Zu diesen Maßnahmen zählen Änderungen von Rechten und Pflichten aus Kreditverträgen einerseits zwischen Schuldnern und Gläubigern und andererseits im Gläubigerkreis. Zuerst werden Gestaltungsmöglichkeiten zur Erleichterung des Handels von bereits bestehenden Forderungstiteln zwischen den Gläubigerbanken geprüft, sodann Gestaltungsmöglichkeiten zur postkontraktuellen Entlastung der Schuldner, und schließlich wird eine Risikoteilung zwischen Gläubigern und Schuldnern ex ante als Weg zu effizienterer Gestaltung von Kreditverträgen erörtert.
