Politikansätze zur Beschleunigung und Vereinfachung von gewerblichen Baugenehmigungsverfahren

Abstract

Auch wenn sich Baugenehmigungsverfahren von Fall zu Fall stark unterscheiden können, wird deren Länge und Komplexität von den Unternehmen vielfach als Belastung und Investitionshemmnis wahrgenommen. Neben den rechtlichen Grundlagen erweisen sich die Vorgehensweise der kommunalen Baubehörden und die Qualität der Mitwirkung der Antragsteller als wichtige Einflussfaktoren. Mittelständische Unternehmen sind von Komplexität und Länge der Verfahren in besonderem Maße betroffen. Abhilfe könnte eine weitgehende Vereinfachung und Verstetigung der Rechtsvorschriften schaffen. Auf kommunaler Ebene sollten die Etablierung einer "Ermöglichungskultur", ein effizientes Verfahrensmanagement und die vollständige Verfahrensdigitalisierung angestrebt werden.
