L’usage de la propriete intellectuelle dans les entreprises artisanales innovantes en France (The use of intellectual property rights in french craft enterprises)

Dans cet article, nous nous posons la question de l’usage de la propriété intellectuelle dans l’entreprise artisanale. Par le biais d’une enquête réalisée sur la période juillet 2008 – mai 2009 auprès de 24 entreprises artisanales françaises qui ont eu recours à la propriété intellectuelle, nous cherchons à comprendre les raisons qui les ont poussé à utiliser les droits et/ou titres de propriété intellectuelle. Ces études de cas nous permettent aussi de dégager les atouts et limites de ceux-ci pour l’entreprise artisanale ainsi que les usages particuliers qu’elle en fait. Il apparaît que la protection du patrimoine intellectuel est un élément important pour les entreprises artisanales. Pour autant les usages de la propriété intellectuelle (constitution de portefeuille de protection, stratégie défensive ou de réputation) sont assez peu différents de ceux que l’on peut trouver dans les entreprises de petite taille. In this paper, we raise the issue of the use of intellectual property rights in the craft enterprise. Through a study on 24 French craft enterprises that have resorted to intellectual property rights, achieved between July 2008 and May 2009, we try to understand the reasons that have led them to make use of them. These case studies also give the possibility to put into light the advantages and the limits of them for the craft enterprise as well as the particular use that it makes of them. The protection of the intellectual patrimony is an important element for craft enterprises. However, the use of intellectual property rights (constitution of protection portfolio, defensive or reputation strategy) are not very different from the way small scale enterprises make use of it.
