Considérations de sécurité nationale dans l’application du droit de la concurrence

Abstract

Les considérations de sécurité nationale occupent une place de plus en plus importante dans l’élaboration des politiques économiques. La prise en compte accrue de ces enjeux reflète l’évolution de la situation géopolitique, les mutations technologiques et l’attention grandissante portée à la sécurité économique, à la résilience et aux capacités technologiques. Comme ces problématiques dépassent le cadre des domaines traditionnellement liés à la défense, elles entrent plus fréquemment en jeu dans l’application du droit de la concurrence à travers un éventail toujours plus large de secteurs, tels que l’énergie, les télécommunications et les technologies de pointe. Dans cette note, nous examinerons les implications qui en découlent pour les autorités de la concurrence et proposerons un cadre d’analyse permettant d’établir une distinction entre a) les préoccupations qui peuvent être évaluées à l’aide d’instruments établis du droit de la concurrence, lorsqu’il est possible d’en formuler les effets pertinents du point de vue de la concurrence, et b) celles qui ne relèvent pas du champ d’action des autorités de la concurrence et nécessitent d’être examinées par les gouvernements ou des instances spécialisées. En nous appuyant sur l’expérience de différentes juridictions, nous analyserons comment les considérations de sécurité nationale sont prises en compte dans le processus d’évaluation des contraintes concurrentielles, du contrôle des fusions, des pratiques coordonnées et des comportements unilatéraux, ainsi que dans la conception des mesures correctives.
