How and When are We Right to Prioritize the Interests of Residents and Citizens?

Abstract

This article assesses an assumption pervasive in one strain of arguments in favor of stringent immigration controls. The assumption affirms that—for the case of regular admissions—to a certain extent states are permitted to prioritize the interests of their citizens and residents by issuing exclusionary immigration policies (call this the priority assumption). Using the normative methodology of applied international ethics, I suggest some broad constraints to this priority assumption that have a bearing on justifications for current practical immigration policy in Europe, North America, and beyond. I do so by redefining borders as domestic‐international institutions that open up borders not only to (internal) standards of justice but also to standards of international legitimacy. Este artículo analiza un supuesto muy diseminado dentro de una cepa de argumentos que favorecen controles de migración rigurosos. El supuesto, que denomino de prioridad, afirma que se permite a los estados, priorizar los intereses de sus ciudadanos y residentes al emitir políticas excluyentes, de cara a admisiones regulares de migrantes. Utilizo en este artículo la metodología de la ética internacional aplicada y planteo algunas restricciones al supuesto de prioridad en caso de que sean relevantes para la justificación de la práctica actual de políticas migratorias en Europa, América del Norte y más allá. Es en plena vista de las restricciones que planteo, que es posible concebir las fronteras como instituciones nacionales e internacionales, sujetas no solo a estándares internos de justicia sino también a los estándares de legitimidad internacional. 本文对一个支持严格移民管制的主张所持的假设进行检验。该假设认为,对于一般准许进入(regular admissions)的案例,各州在一定程度上有权通过颁布排外移民政策,优先关照其公民和居民的利益(将其称为优先权假设)。通过使用应用国际伦理(Applied International Ethics)的规范性方法论,我认为该伦理假设存在一些限制,前者能明确影响当前欧洲、北美和其他地区的实际移民政策的相关辩护。我通过重新定义边境,将其作为不仅受制于(内部)司法标准,还受制于国际合法性标准的国内‐国际制度,进而发现了该伦理假设的限制。
