Abstract

Zusammenfassung Geschäftsmodelle der digitalen Ökonomie basieren auf dem Angebot von Inhalten und Diensten, die von den Kunden teilweise mit personenbezogenen Informationen bezahlt werden. Vorteile entstehen, weil dies zu einer effizienteren Bereitstellung von Gütern und Dienstleistungen führen kann. Nachteile liegen bei einer Gefährdung des Datenschutzes. Wettbewerbsprobleme ergeben sich, wenn es durch Big Data zu einem Zuwachs von Marktmacht kommt. Die Autoren halten die Instrumente des Wettbewerbsrechts durchaus für tauglich, um diese Probleme zu bewältigen. Allerdings sollte das Datenschutzrecht an die digitale Wirtschaft angepasst werden. Insbesondere sollte Transparenz darüber herrschen, wie die Plattformen die erhobenen Daten verwenden und welche Daten überhaupt gesammelt werden.
