Zukunft der Sozialpartnerschaft – Chancen und Herausforderungen

Abstract

Shortage of skilled labour, demographic change and structural transformation – Germany as a business location is currently facing major strategic challenges. But the social partnership in Germany is also facing major challenges. A decline in the validity of collective agreements has been observed since the end of the 1990 s, which has a direct impact on the structure and organisation of employers’ associations and trade unions. A changing world of work also presents the social partners with new challenges. It is necessary to find sustainable and solution-orientated answers together in order to increase the strategic competitiveness of the country, offer good and competitive jobs and thus secure the future prosperity of our country. This responsibility is originally assigned to the social partners and the collective bargaining partners by Article 9 (3) of the German Constitution. The social partners are therefore called upon first and foremost to strengthen collective bargaining autonomy and collective bargaining commitment beyond state coercion. Collective bargaining opening clauses and a modular collective bargaining policy can make a valuable contribution to modern collective bargaining autonomy. Fachkräftemangel, demografischer Wandel und Strukturwandel – der Wirtschaftsstandort Deutschland steht aktuell vor großen strategischen Herausforderungen. Aber auch die Sozialpartnerschaft in Deutschland steht vor großen Herausforderungen. Bereits seit Ende der 90er-Jahre lässt sich eine rückläufige Geltung von Tarifverträgen beobachten, was unmittelbare Auswirkungen auf die Struktur und Organisation von Arbeitgeberverbänden und Gewerkschaften hat. Gleichzeitig stellt eine sich verändernde Arbeitswelt die Sozialpartner vor neue Aufgaben. Um angesichts dieser Lage die strategische Wettbewerbsfähigkeit unseres Standortes zu steigern, gute und wettbewerbsfähige Arbeitsplätze zu gewährleisten und damit den zukünftigen Wohlstand unseres Landes zu sichern, ist es notwendig, gemeinsam zukunftsfähige und lösungsorientiere Antworten zu finden. Diese Verantwortung wird durch Art. 9 Abs. 3 unseres Grundgesetzes originär den Sozial- und Tarifpartnern zugewiesen. Daher sind gerade und in aller erster Linie die Sozialpartner aufgerufen, Tarifautonomie und Tarifbindung jenseits staatlichen Zwangs zu stärken. Tarifliche Öffnungsklauseln und eine modulare Tarifpolitik können in einer modernen Tarifautonomie hierfür ein wertvoller Beitrag sein.
