Efficienza Tecnica e Geografia Giudiziaria

Abstract

La geografia giudiziaria Italiana, rimasta sostanzialmente invariata dai tempi dell’Unità d’Italia, ha subito una radicale trasformazione con la riforma contenuta nella Legge n. 148 del 2011 e nei relativi decreti attuativi n. 155 e 156 del 2012. Nel dettaglio, il Decreto Legislativo n. 155 del 2012 ha programmato la soppressione di 31 Tribunali Ordinari e relative Procure (pari al 19% del numero iniziale) e di tutte le 220 sezioni distaccate. Questo è un lavoro empirico che studia l'impatto atteso di questa policy, sia in termini di efficienza tecnica, sia in termini di costo sociale. Da un lato, mediante la tecnica della Data Envelopment Analysis (DEA), l'autore testa l'ipotesi di economie di specializzazione nei Tribunali Ordinari; dall'altro propone lo studio della litigiosità e come la superficie di competenza del circondario è in grado di condizionarla. I risultati confermano l'impatto positivo in termini di efficienza, ma altresì una riduzione attesa della domanda di giustizia dovuta ai costi legati all’accorpamento degli stessi uffici giudiziari che, inevitabilmente, ricadranno sui cittadini e/o imprese. Inoltre, a causa dell'approccio adottato dal legislatore in sede d'individuazione degli uffici da sopprimere, è plausibile ipotizzare un aumento del divario, in termini di efficienza, tra l'Italia Settentrionale e quella Meridionale.
