TTIP: Chance Handel - Risiko Investorenschutz

Abstract

Anfang Februar 2015 startete in Brüssel die achte Verhandlungsrunde zur Transatlantischen Handels- und Investitionspartnerschaft (TTIP). Ziel der Initiative ist der Abbau von Handelsund Investitionshemmnissen, um sowohl den Vereinigten Staaten als auch den Ländern der Europäischen Union Wohlfahrtsgewinne durch eine weitere Vertiefung ihrer internationalen Arbeitsteilung zu ermöglichen. Zumindest in der ökonomischen Fachwelt wird diese Zielsetzung durchgängig begrüßt. Zunehmend Zweifel gibt es aber daran, ob die dabei eingeschlagenen Wege tatsächlich wohlfahrtsfördernd sind. Der Disput entzündete sich zunächst an der Frage, inwieweit es gelingen kann, die etablierten europäischen Produktstandards in den Verhandlungen mit den transatlantischen Partnern zu bewahren. Das amerikanische Chlorhühnchen wurde gleichsam zum Wappentier der TTIP-Kritik. Dabei stellen international unterschiedliche Produktstandards zwar ein schwieriges, aber keineswegs unüberwindbares Verhandlungshemmnis dar, denn dem Verbraucherschutz kann in den allermeisten Fällen durch eine klare Deklarationspflicht der Produkte Genüge getan werden. Wer kein Chlorhühnchen mag, kann ihm aus dem Weg gehen, wenn die Behandlungsmethode auf der Verpackung klar erkennbar ist. Im Laufe der Debatten geriet allerdings das Chlorhühnchen zunehmend in den Hintergrund und der im Abkommen vorgesehene Investorenschutz immer stärker in den Vordergrund - und das zu Recht. Wie in diesem Policy Brief aufgezeigt wird, mehren sich die Hinweise, dass Investitionsschutzabkommen von internationalen Konzernen zunehmend missbräuchlich ausgenutzt werden. Dementsprechend bedürfen die herkömmlichen Regeln, die in derartigen Abkommen üblicherweise zur Anwendung kommen, dringend der Überarbeitung.
